Event Terms & Conditions

 

Booking & Payment

All events must be paid in full no later than fourteen (14) days prior to the scheduled event date. Events booked within fourteen (14) days must be paid in full at the time of booking. All payments are non-refundable.

 

Guest Count

The final number of painters is confirmed at the time of booking and determines total pricing. Reductions in guest count are not permitted after booking. Additional painters may be accommodated up to seven (7) days prior to the event, subject to availability and additional charges.

 

Event Timing

Standard party duration is approximately two (2) hours unless otherwise specified. The event will begin at the scheduled start time regardless of guest arrival. Client must provide a minimum of one (1) hour prior to the event for setup. Delays caused by venue access or incomplete setup will not extend the event duration.

 

Venue Requirements

Client must provide an appropriate indoor space or a fully covered outdoor area, subject to Company approval. Access to a sink, a minimum of two (2) electrical outlets, adequate lighting, and sufficient space for all participants and equipment is required. The Company reserves the right to modify or refuse setup if conditions are deemed unsuitable.

 

Tables, Chairs & Surface Protection

Client may choose to provide tables and chairs or have them included through the selected package. If provided by the Client, all tables and chairs must be set up and ready prior to the Company’s arrival.

 

Client is responsible for covering and protecting all tables, chairs, floors, walls, ceilings, and surrounding areas. The Company is not responsible for any stains, spills, or damage resulting from normal paint party activities.

 

At the Client’s request only, the Company may provide a protective covering beneath the tables and chairs supplied by the Company. The Company is not responsible for protecting any surfaces or furniture not provided by the Company.

 

Painting Selection

A painting design must be selected prior to the event. If a design is not confirmed within the required timeframe, the Company reserves the right to select an appropriate design.

 

Safety, Materials & Supervision

Paint parties involve inherent risks, including but not limited to spills, slipping, allergic reactions, choking hazards, and injury. Latex balloons, if present, may cause allergic reactions.

 

The Company is not responsible for supervising children or monitoring guest behavior. Client assumes full responsibility for all guests and agrees to supervise children at all times.

 

The Company is not responsible for any misuse of materials, including ingestion of paint, balloons, or decor items by children or adults.

 

Decor & Equipment

All decor and equipment must be handled only by Company staff. No items may be moved, adjusted, or handled by guests.

 

The Company is not responsible for damage or injury resulting from unauthorized handling.

 

If decor services are included, all items remain the property of the Company unless otherwise stated. Client is responsible for any damage, loss, or theft of decor items during the event.

 

Outdoor conditions, including weather and environment, may affect decor quality and longevity. No guarantees are made for such conditions.

 

Cancellation & Rescheduling

All payments are non-refundable. If cancellation occurs with at least seven (7) days’ notice, payments may be applied as credit toward a future event, valid for up to one (1) year. Cancellations made within seven (7) days of the event are not eligible for credit. Rescheduling is subject to availability.

 

Right to Refuse Service

The Company reserves the right to refuse or discontinue services if event conditions are unsafe, disruptive, or do not meet the requirements outlined above. In such cases, no refunds will be issued.

 

Force Majeure

The Company is not responsible for delays or cancellations due to events beyond its control, including but not limited to severe weather, natural disasters, accidents, or emergencies. In such cases, rescheduling or credit may be offered at the Company’s discretion.

 

Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any injury, illness, allergic reaction, property damage, loss, or death arising from participation in the event, except in cases of gross negligence or intentional misconduct.

 

By booking services, the Client acknowledges and agrees to these Event Terms & Conditions.

Website Terms and Conditions of Use

1. Terms

By accessing this website (the “Site”), the person(s) accessing the Site (“You” or “Your”) is agreeing to be bound by, and responsible for compliance with, the Website Terms and Conditions of Use (the “Terms of Use”) of Paint Parties Plus, affiliated companies, and its authorized agents, employees and assignees (collectively, “Paint Parties Plus”) and all applicable laws and regulations, including applicable local laws. If You do not agree with any of the Terms of Use, You are prohibited from using or accessing the Site. The Materials contained in the Site are protected by applicable copyright and trademark laws.

2. Proprietary Rights

Notwithstanding anything to the contrary herein, Paint Parties Plus owns, solely and exclusively, all rights, title and interest in and to the Site, all the content (including, but not limited to, audio, photographs, illustrations, graphics, other visuals, video, copy, text, and software), code and date on the Site, including, but not limited to, any copyrights, trademark rights, patent rights, database rights and other intellectual property and proprietary rights therein (collectively, the “Materials”). Your use of the Site does not grant to You ownership of the Materials that You may access on or through the Site.

3. Use License

Permission is granted to access and view the Materials and, unless otherwise indicated in these Terms of Use, download one (1) copy of the Materials for personal, non-commercial transitory viewing only (the “License”). The License is not a transfer of title. Under the License, You may not:

• Modify the Materials or copy the Materials more than one (1) time;

• Use the Materials for any commercial purpose, or for any public display (commercial or non-commercial);

• Attempt to decompile or reverse engineer the Materials;

• Remove any copyright or other proprietary notations from the Materials; or

• Transfer the Materials to any other person, or “mirror” the Materials on any other server.

The License shall automatically terminate if You violate any of the Terms of Use. The License may be terminated by Paint Parties Plus at any time. Upon termination of the License, You must destroy any downloaded or copied Materials in Your possession whether in electronic or printed format.

4. Chargeback Policy

All references to a “chargeback” refer to a reversal of a credit or debit card charge placed on the Sites and/or at the Services initiated by You. There is no reason for a chargeback to ever be filed. If You feel that Your credit or debit card was used fraudulently on the Sites or at the Services, please contact Paint Parties Plus for immediate resolution.

YOU AGREE THAT YOU WILL NOT CHARGEBACK ANY AMOUNTS CHARGED TO YOUR CREDIT OR DEBIT CARD ON THE SITES OR AT THE SERVICES. IF YOU CHARGEBACK A CREDIT OR DEBIT CARD CHARGE FOR A PAYMENT INITIATED BY YOU OR ANY AUTHORIZED USER OF THE CREDIT OR DEBIT CARD, YOU AGREE THAT PAINT PARTIES PLUS MAY RECOVER THE AMOUNT OF THE CHARGEBACK IN ADDITION TO FEES BY ANY MEANS DEEMED NECESSARY, INCLUDING, BUT NOT LIMITED TO, RECHARGING YOUR CREDIT OR DEBIT CARD OR HAVING THE AMOUNT RECOVERED BY A COLLECTION AGENCY.

5. Disclaimer

THE MATERIALS ON THE SITE ARE PROVIDED “AS IS”. PAINT PARTIES PLUS MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS. FURTHER, PAINT PARTIES PLUS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON THE SITE OR ON ANY SITES LINKED TO THE SITE. WE ARE NOT RESPONSIBLE FOR THE CREATIVE OUTCOME (HOW THE FINISHED PRODUCT OF ANY PAINTING PRODUCED BY YOU OR YOU PARTY GUESTS LOOKS OR FEELS.)

6. Limitations

IN NO EVENT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL PAINT PARTIES PLUS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND OR CHARACTER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE SITE OR THE MATERIALS ON THE SITE, EVEN IF PAINT PARTIES PLUS HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE.

7. Indemnification

You agree to defend, indemnify and hold Paint Parties Plus harmless from any and all claims, demands, causes of action, costs, expenses, attorney’s fees, damages or liabilities of any kind arising out of or relating, in whole or in part, to the use or inability to use the Site or the Materials on the Site, or Your breach or violation of the law or of these Terms of Use  . You agree to defend, indemnify and hold Paint Parties Plus harmless from any and all claims, demands, causes of action, costs, expenses, attorney’s fees, damages or liabilities of any kind arising out of or relating, in whole or in part, to the use or inability to use of your private property or rented equipment.

8. Revisions and Errata

The Materials appearing on the Site may include technical, typographical, or photographic errors. Paint Parties Plus does not warrant that any of the Materials on the Site are accurate, complete, or current. Paint Parties Plus may make changes to the Materials contained on the Site at any time without notice. Paint Parties Plus does not, however, make any commitment to update the Materials.

9. Links

Paint Parties Plus has not reviewed all of the websites linked to the Site and is not responsible for the content of any such linked websites. The inclusion of any link to a website does not imply endorsement by Paint Parties Plus of such website, and the use of any such linked web site is at Your own risk.

10. Terms of Use Modifications

Paint Parties Plus may revise the Terms of Use for the Site at any time without notice. By accessing the Site, You are agreeing to be bound by the then-current version of the Terms of Use.

11. Governing Law

Any claim relating to the Site or the Terms of Use shall be governed by the laws of the State of New York without regard to its conflict of law provisions.
